Disputes regarding the distribution of an estate may involve different views as to the interpretation of a Will or they might involve a suggestion by one party that the person who died was not capable of making a Will or was forced to write it the way they did. There might be claims by children of somebody who has died that their parents have not made “proper provision” for them in their Will. These cases are known as “Section 117 Applications”.

If a person objects to another administering the estate (i.e. taking charge of distributing the assets), they can apply to the Probate Office to prevent this happening and ultimately if the parties can’t agree, the matter will be decided by the Court.

In contentious business, a solicitor may not calculate fees or other charges as a percentage or proportion of any award or settlement.
